Terms and Conditions of Sale

Culinary Equipment Company Pty Ltd “Culinary” also trading as Lacanche South Africa

  1. PRICING Commissioning fee will be invoiced separately at date of installation. All quotations are based on current supply prices and exchange rates. Quotes are thus valid for a period of 7 (seven) days from quotation date. We reserve the right to change pricing influenced by the exchange rate after this point. Prices of items will not change after the quote has been accepted.
  2. TERMS OF PAYMENT Item in Stock - 100% deposit payable on acceptance and signature of quotation. Items quoted are only reserved once payment confirmation and signed quote documents are received. If necessary, items will be stored at our warehouse at no extra charge. Insurance is not included. Orders on Bespoke units - For units ordered to be built/made to clients specifications, we require a deposit of 75% The balance is payable on receipt of the unit at our warehouse in Lanseria, prior to delivery. If necessary, items will be stored at our warehouse at no extra charge. Insurance not included.
    1. Any method of payment, except cheque or credt card, will be accepted.

CANCELLATION POLICY

  1. Lacanche cookers are custom made-to-order product which require a deposit of 75% on order for custom manufacture and 100% on order for in-stock units.
  2. Cancellation of any order by a customer must be advised to Culinary in writing or by email to and confirmation of receipt thereof must be received from Culinary.
    1. Cancellation penalties for custom-order (75% deposit) orders by a customer where:

i. The supplier has not yet put the cooker into manfucture will incur no cancellation penalty for the customer. Culinary does, however, reserve the right to charge a fee of R7500 to cover the cost of administration.

ii. The supplier has begun manufacture of the customer’s order but without the order having left France for shipment to South Africa will result in a penalty of 50% of the value of the order plus any additional costs relating thereto to be levied against the customer cancelling the order. The customer may request Culinary to sell the cooker as an agent on their behalf at their discretion upon the sale thereof the penalty shall be refunded to the customer.

iii. The cooker has been manufactured and left France fir shipment to South Africa may not be cancelled. The customer will be required to take delivery of the cooker or may request Culinary to sell the cooker as an agent on their behalf.

iv. Also shall be subject to Culinary’s internal returns procedures and financial controls.

  1. Cancellation penalties for stock unit orders (100% deposit) orders by customers where a refund for the value of the order shall be processed subject to the following fees:

i. Storage fees for cookers held after deposit shall be calculated at 1% of the cooker’s value per month and deducted from any refund.

ii. Shipping and handling fees (e.g. from our Joburg to Cape Town warehouse) shall be deducted at cost from any refund.

iii. An administration fee of up to R5000 shall be deducted from any refund.

iv. Also shall be subject to Culinary’s internal returns procedures and financial controls.

DELIVERY & INSURANCE

  1. Approximate delivery dates are given on final order confirmation. All items are sea-freighted. Items can be air-freighted upon request. A second quotation for transport will be offered at the cost for air freight over that of sea freight.
  2. Delivery fee will be invoiced separately at date of installation (if not included in the main quote). Delivery of quoted items is subject to availability. If an item arrives at our warehouse before it can be delivered, Culinary will store the unit at no charge for up to 18 months. Insurance is not included during storage. Culinary takes no responsibility for damages during the period of storage.
  3. Delivery fees are calculated as follows:
    1. Within 50km's of Lanseria, JHB : 1% of invoice total.
    2. Within 50km's of our depots (Pinetown, KZN / Wynburg, CPT) : 3% of invoice total.
    3. All other areas will be subject to quotation from our transportation company.

INSTALLATION

  1. Culinary does not furnish site work with regard to installations nor during the course of providing service / maintenance to units. Upon acceptance of a quote, Culinary will provide electrical, gas and plumbing requirements.
  2. All quotations are for the supply of the above equipment, and excludes any building, electrical, refrigeration, plumbing, (unless otherwise stated), or any other work required to install the above.
  3. Culinary does not provide any insurance on units during transport or installation.
  4. All installation and delivery site work will be deemed to be complete after all equipment supplied has been placed in the position indicated by the customer. Any callout / service rendered after delivery is billable at standard Culinary callout rates.
  5. The customer is responsible for providing reasonable access for delivery, including no obstructions, suitable openings, no stair cases etc.
  6. The customer agrees that they take full responsibility for the unit once placed on their property.
  7. Culinary reserves the right to provide kerb-side delivery if reasonable site access is not available.
  8. The customer indemnifies Culinary from any damage which may occur to the unit after placement.
  9. The customer indemnifies Culinary against any site damage caused during the delivery, excluding gross negligence.
  10. Any damage caused by any third party will be for the customer's account.
  11. Any damage caused to the customer's unit during transport shall be for Culinary's account. Any damage to the customer's unit once offloaded or on to the customer's property shall be for the customer's account.

GAS AND ELECTRICAL CONNECTIONS

  1. A certified gas installer is required to install any gas lines from the town gas/LP gas to the cooker.
  2. A certified gas installer is required to certify and issue a certificate of compliance for any gas connection made to a Lacanche cooker, notwithstanding the physical connection being made by a Culinary technician.
  3. A certified gas installer is required to ensure that all gas settings and connections comply with South African law and industry standards.
  4. Culinary Equipment Company and its employees or agents are not registered gas installers and may not install, or certify connections for gas to our cookers.
  5. A certified electrician is required to install any electrical cabling or connections from your DB board/electricity feed to the cooker.
  6. A certified electrician is required to certifiy and issue a certificate of compliance for any electrical connection made to a Lacanche cooker, notwithstanding the physical connection being made by a Culinary technician.
  7. A certified electrician is required to ensure that all electrical settings and connections comply with South African law and industry standards.
  8. Culinary Equipment Company and its employees or agents are not registered electrical installers and may not install, or certify connections for electricity to our cookers.
  9. Connections of gas and electricity are made at the clients’ risk and under the liability of the client or the client’s certified gas installer or certified electrician. Culinary Equipment Company, its agents and employees make no warranty (either express, or implied) regarding the connection of the above mentioned services to Lacanche cookers.

OTHER GENERAL CONDITIONS OF SALE

  1. All sales are subject to the Culinary Equipment Company's Terms and Conditions of Sale, which are available at www.culinary.co.za or from any Culinary representative or store. Upon signing this document, the customer agrees to having read and understood the Terms and Conditions of Sale. Approximate delivery dates are given on final order confirmation. All items are sea-freighted. Items can be air-freighted upon request. A second quotation for transport will be offered at the cost for air freight over that of sea freight.

WARRANTY

  1. Culinary has a universal warranty which applies to all its products. This warranty is available at https://www.culinary.co.za/warranty-policy, from a representative, or from any one of our stores. Upon signing this document the client acknowledges having read and understood the Warranty Policy as well as its accompanying Returns Policy available at https://www.culinary.co.za/orders-returns .

ADDITIONAL WORK

  1. On site equipment training, technician on operation and chef on use, by arrangement only.

CONFIDENTIALITY

  1. © Any designs, details or specifications contained in this quote remain the property of the Culinary Equipment Company. Any copying, distribution, or sharing either in part or in whole of the contents of this document is expressly prohibited.

ENTIRE AGREEMENT

  1. These conditions and those other terms and conditions referenced above shall be the entire agreement between the parties unless agreed by both parties in writing.
